The emmi EMAG AG mobile messaging service (hereinafter "Service") is operated by emmi EMAG AG ("emmi EMAG AG," "we," or "us"). Your use of this Service constitutes your acceptance of these terms of use ("Mobile Terms of Use"). We reserve the right to modify or discontinue the Service or individual features thereof at any time without prior notice. To the extent permitted by law, we may also modify these Mobile Terms of Use at any time. Your continued use of the Service after such modifications become effective constitutes your acceptance of the modified terms.

By consenting to the emmi EMAG AG SMS/text messaging service, you agree to receive recurring SMS/text messages from or on behalf of emmi EMAG AG via your mobile phone provider to the mobile number you provide, even if that number is registered on a state or federal "do not call" list. Messages may be sent automatically. Service-related messages may include, for example, order or account updates. Promotional messages may include, for example, offers, promotions, or shopping cart reminders.

You are not required to register for this service to make purchases from emmi EMAG AG. Your consent is not a prerequisite for making a purchase. Participation in the messaging service is entirely voluntary.

We do not charge for the service. However, you are responsible for any charges and fees charged by your wireless service provider for receiving SMS/text messages. Message frequency may vary. Your carrier's messaging and data rates may apply. Please check with your wireless service provider for possible charges.

You can unsubscribe from the service at any time. To do so, send the keyword STOP to "emmiNAIL" or click the unsubscribe link (if available) in a message you receive. After unsubscribing, you will receive a one-time confirmation. No further messages will be sent after that unless you initiate this again. If you are also subscribed to other SMS services from emmi EMAG AG, you may need to unsubscribe separately, unless otherwise required by law.

We reserve the right to change the short codes or phone numbers used to operate the service at any time. If you send a message (e.g., STOP or HELP) to an outdated number, we cannot guarantee that your request will be received or processed.

The mobile operators that support this service are not responsible for delayed or undelivered messages. You agree to provide us with a valid mobile phone number. If you change your number, you will need to re-register for the service.

To the extent permitted by law, we assume no liability for any inaccurate, delayed or misdirected messages or for any decisions you make based on such information.
